A History of the Louisiana Civil Code: The Formative Years, 1803-1839

Richard Kilbourne has produced a long overdue and desperately needed analysis of the Louisiana Civil Code of 1825. Kilbourne traces the 1825 Code's development from the cession of Louisiana by France in 1803, to the landmark Louisiana Supreme Court decision Reynolds v. Swain in 1839. This little-known decision concluded a twenty year struggle between the Louisiana Supreme Court and the Louisiana legislature to establish the role of each in determining the sources of Louisiana law.
