The Revision of the Louisiana Co-Ownership Law

In 1990, the Louisiana legislature passed Act No. 990, which continued the revision and modernization of the Louisiana Civil Code. The Act adds articles 797 through 818, which regulate co-ownership. These articles now comprise title VII of book II, entitled “Ownership in Indivision.” The purpose of the revision is not to change the law, except in a few clear instances. Rather, the redactors sought to collect and clarify the various principles, most of which had been developed by the courts to govern the regime of ownership in indivision. This Comment will examine the new articles and their sources to determine what changes are likely to result from these additions to the Code.
