Roman Law in the French and Louisiana Civil Codes: A Comparative Textual Survey

The present essay has a triple purpose: first, to determine which Roman law, the Roman law as understood by writers of the ancien régime or the Roman law compiled in the Corpus Iuris Civilis, was a source of the French Civil Code; second, to reexamine the Roman law used in the drafting of the Louisiana Civil Codes of 1808, 1825, and 1870; and third, to respond to a new criticism of some of the findings this writer made public over twenty years ago.
