The Relationship of Status and Damages in Maritime Personal Injury Cases

This Article details the importance of a plaintiff's status for recovery of personal injury damages in maritime law. It examines the qualifying tests and available damages for seamen, longshore and harbor workers, offshore workers, scientific research workers, general passengers, and other maritime tort victims. Analysis of the available recovery, particularly the changing law on nonpecuniary damages, demonstrates the inconsistency in maritime law, despite the stated goal of uniformity.
