Pipe Dreams: Has Louisiana Become Too Generous in Finding Public Use in Oil and Gas Extrapolation Proceedings?

Comment by Andrew J. Mahtook

This Comment will focus on the public use requirement in Louisiana as it relates to oil and gas companies. It will discuss Louisiana's expropriation laws and its public use doctrine, as well as their development, and the modern application of the law, including the Bayou Bridge litigation. The Comment will also analyze how federal and other state courts have treated similar types of industries who seek to expropriate land in order to compare the treatment in those cases with the current treatment of Louisiana's oil and gas industry.
