Hassen v. Ruston Louisiana Hospital Co.: A Fifth Circuit Majority Gives Leeway to Employers Defending Allegations of Discrimination

After the Fifth Circuit's decision in Hassen v. Ruston Louisiana Hospital Co., 932 F.3d 353 (5th Cir. 2019), employers defending allegations of discrimination face a relatively lenient standard for justifying their decisions. This Note questions the majority's leniency on what constitutes a consistent explanation and endorses the dissent's stricter standard for employers' explanations for potentially discriminatory decisions.
